DraftMeUp Terms of Service
Effective Date: August 8,2025
PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING DRAFTMEUP. BY ACCESSING OR USING OUR PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
1. Acceptance of Terms By accessing or using DraftMeUp (“we,” “us,” or “our”), you agree to comply with and be legally bound by these Terms of Service (“Terms”). These Terms apply to all users, including athletes, recruiters, agencies, and visitors.
2. Eligibility To use our services, you must be at least 18 years old and legally capable of entering into a binding agreement. You agree to provide accurate, complete, and updated information during registration and to maintain the security of your account.
3. User Responsibilities and Conduct You agree not to:
Use the platform for unlawful, fraudulent, or abusive purposes.
Impersonate any person or entity.
Post or upload false, misleading, or defamatory content.
Attempt to interfere with or compromise the integrity of the platform.
Harvest or collect personal data about other users.
We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms.
4. Membership Plans and Payments All memberships and services are billed at the time of purchase and are non-refundable unless otherwise stated by law. You authorize us to charge your provided payment method on a recurring basis if applicable. We reserve the right to change pricing with reasonable notice.
5. Intellectual Property Rights All content on DraftMeUp—including but not limited to logos, graphics, text, design, and software—is owned by or licensed to us and is protected under intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without written consent.
6. User-Generated Content You retain ownership of content you upload but grant us a worldwide, royalty-free, sublicensable license to use, display, and distribute such content in connection with providing our services. You are solely responsible for the accuracy and legality of your content.
7. No Guarantees or Endorsements DraftMeUp does not guarantee job placements, athlete signings, or any outcomes from connections made on the platform. We do not endorse or verify any user, profile, or organization. You use the platform at your own risk.
8. Limitation of Liability To the fullest extent permitted by law, DraftMeUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages or any loss of profits, revenues, or data. Our total liability shall not exceed the amount you paid to us in the three months prior to the event giving rise to the claim.
9. Indemnification You agree to indemnify, defend, and hold harmless DraftMeUp and its affiliates, officers, agents, and employees from and against any claims, damages, obligations, losses, or liabilities arising out of your use of the platform or violation of these Terms.
10. Privacy Your use of DraftMeUp is subject to our Privacy Policy, which governs the collection and use of your data. By using the platform, you consent to such data practices.
11. Termination We may suspend or terminate your access to the platform at any time and without notice if we believe you have violated these Terms or engaged in conduct that harms DraftMeUp, its users, or its reputation.
12. Dispute Resolution All disputes arising from these Terms shall be governed by the laws of the Province of Ontario, Canada. You agree to resolve any claim or dispute through binding arbitration and waive any right to participate in a class-action lawsuit or class-wide arbitration.
13. Changes to Terms We may update these Terms at any time. Changes will be effective immediately upon posting. Your continued use of DraftMeUp after any such updates constitutes acceptance of the revised Terms.
